This MCLE program covers the three ways that law firms are currently handling e-discovery through a cost benefit analysis standpoint and what has the potential for sanctions. The analysis is conducted with the use of a sample data set that could be found in any litigation matter today. It covers many of the terms and ideologies that are commonly seen in the ESI space. This MCLE has been utilized by firms for the following: 1) Introduction to efficient e-discovery review and production; 2) How to justify a Protective Order for production of electronic files due to burden of cost; and, 3) What red flags to look for when trying to get a Motion to Compel for production of electronic documents.
